Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of Classhub.my (the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Classhub.my is a class communication platform for Malaysian schools and families. Any registered user can create a class and manage timetables, homework, attendance, announcements, and chat. Any user can also join existing classes as a teacher, parent, or student, using a class join code. Paid plans unlock additional classes and advanced features.

3. Eligibility, Accounts, and Security

• Accurate information: You must provide accurate and complete information and keep it updated.
• Account security: You are responsible for safeguarding your login credentials and for all activity under your account.
• Age and capacity: If you are under the age of majority or otherwise lack legal capacity, you may only use the Service with the consent and supervision of a parent/guardian (and where applicable, your school). If you are under 13, your parent/guardian must consent and may need to create or operate the account on your behalf.
• One account per person: Unless we approve otherwise, one person should not operate multiple accounts.

4. Roles, Classroom Administration, and Authority

All registered users share a unified account type. Within each class, members hold a class-level role (teacher, parent, or student) which determines what they can see and do inside that class.

Class teachers / administrators are responsible for:

• Managing class content (e.g., timetable, homework, announcements, attendance) and ensuring it is appropriate and accurate.
• Managing membership (e.g., join codes/approvals) and moderating class chat and conduct within their classes.
• Ensuring they have the right to invite users and to upload or input any information (including student information) into the Service.

Parents and students agree to:

• Use the platform respectfully and for educational purposes
• Not share class join codes publicly
• Report any misuse to the class teacher or Classhub support

We do not control or independently verify class content created by users. Class teachers/administrators remain responsible for their classes.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal, harmful, or unauthorized purpose
• Share unlawful, infringing, abusive, or obscene content
• Harass, bully, threaten, impersonate, or exploit others
• Attempt to access other users' data or accounts without authorization
• Probe, scan, test, or bypass our security or anti-abuse measures
• Interfere with the Service's operation (e.g., spam, bots, scraping)
• Upload malware or attempt to introduce vulnerabilities

6. User Content

You retain ownership of the content you submit to the Service (“User Content”). To operate the Service, you grant us a non-exclusive, worldwide license to host, store, reproduce, transmit, display, and otherwise process User Content as necessary to provide, maintain, and improve the Service.

You represent and warrant that you have all rights necessary to submit User Content and that your User Content does not violate any law or the rights of any person (including privacy, publicity, and intellectual property rights).

We may remove or restrict access to User Content if we reasonably believe it violates these Terms, poses a risk, or is required by law.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by us and protected by applicable intellectual property laws. Except for the limited rights expressly granted to you, we reserve all rights, title, and interest in and to the Service and our trademarks.

8. Paid Plans, Payments, and Refunds

• Free plan: All users may create 1 class and join 1 class at no cost, with access to core class management features.
• Parent Pro: A subscription (RM8/month or RM79/year) that allows the subscriber to join unlimited classes. The subscriber can still create 1 class with full management features.
• Class Pro: A subscription (RM29/month or RM299/year) that allows the subscriber to create and join unlimited classes, plus access to advanced features including quizzes, analytics, data exports, and bulk announcements.
• School Pro: Available by enquiry only (not self-serve). Includes a school admin dashboard, teacher and timetable management, and school-wide reporting. Contact us at classhub.my/school-enquiry for a custom quotation.
• Class access on expiry: When a paid subscription expires and is not renewed, access reverts to Free plan limits. Classes and data created during a paid period are retained, but classes beyond the Free limit become locked until the plan is renewed.
• Payments: Payments are processed by third-party payment providers (currently Stripe, including cards, FPX, and selected local e-wallets where available). We do not store your banking credentials.
• No auto-renewal: Subscriptions expire at the end of the paid period and do not auto-renew. You must purchase again to continue access beyond the Free plan.
• Refunds: Fees are non-refundable except where required by applicable law. We may provide goodwill refunds or credits at our discretion.

9. Third-Party Services

The Service may integrate with third-party services (for example, authentication providers, infrastructure providers, and payment processors). Your use of third-party services may be subject to their own terms and policies. We are not responsible for third-party services that are not operated by us.

10. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service if we reasonably believe you have violated these Terms, pose a risk to other users, or if required by law. You may stop using the Service at any time. Requests to delete an account can be made by contacting us.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Service is not an emergency service and should not be relied upon as the sole recordkeeping system for a school. You are responsible for maintaining your own backups and records as appropriate.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

To the fullest extent permitted by law, our total liability for any claims arising out of or related to the Service will not exceed the greater of (a) the total fees you paid to us for the Service in the 12 months before the event giving rise to the claim, or (b) RM100.

13. Indemnity

You will indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your breach of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to provide notice (for example via the Service or by email). Continued use of the Service after the effective date of updated Terms constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of Malaysia. Any disputes shall be brought in the courts of Malaysia, unless applicable law requires otherwise.

16. Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
• No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations as part of a reorganization, merger, acquisition, or sale of assets.
